Alan Dershowitz: Yes, Using the 25th Amendment to Oust Trump is an Attempted Coup

“a grievous offense against the Constitution”

Andrew McCabe’s new revelations about high level meetings to discuss removing Trump have been described as an attempted coup. Harvard law professor Alan Dershowitz says if the 25th Amendment was on the table, then it absolutely was an attempted coup.

He explained this on the Tucker Carlson show this week.

Bradford Betz of FOX News has details:

Alan Dershowitz: Ousting Trump via 25th Amendment is ‘clearly an attempt at a coup d’etat’

Harvard Law professor Alan Dershowitz on Thursday said the Department of Justice’s discussions to employ the 25th Amendment to oust President Trump– if true– amounted to an attempted coup.

Dershowitz appeared on Fox News’ “Tucker Carlson Tonight,” to give his take on former FBI Deputy Director Andrew McCabe’s descriptions of Justice Department meetings where he said officials discussed ousting the president.

“If [McCabe’s comments are] true, it is clearly an attempt at a coup d’état,” Dershowitz said.

Evoking the 25th Amendment, Dershowitz added, would be a fundamental misuse of its original purpose. He said it was originally “about Woodrow Wilson having a stroke. It’s about a president being shot and not being able to perform his office.”

Dershowitz said any justice official who discussed the 25th Amendment in the context of ousting the president “has committed a grievous offense against the Constitution.”

Trump clearly appreciates the support. He is already quoting Dershowitz on this.

Caitlin Yilek writes at the Washington Examiner:

Trump quotes Alan Dershowitz saying consideration of 25th Amendment ‘despicable’

President Trump quoted Harvard Law professor Alan Dershowitz Thursday night to defend himself amid renewed talk that Justice Department officials weighed asking Cabinet members to consider invoking the 25th Amendment to remove the president from office.

“Any Justice Department official who even mentioned the 25th Amendment in the context of President Trump has committed a grievous offense against the Constitution,” Dershowitz told Fox New’s Tucker Carlson on Thursday.

“The framers of the 25th Amendment had in mind something very specific and trying to use the 25th Amendment to circumvent the impeachment provisions or to circumvent an election is a despicable act of unconstitutional power grabbing,” Dershowitz continued.

    Here’s Trump’s tweet:

That’s what all of this has been about. The Russia investigation, the daily outrages, etc.

Democrats, their allies in media, and their agents in the deep state tried to undo the results of the 2016 election.

“That’s what all of this has been about.”

That’s not all this has been about. I believe the main purpose of “all of this” has been to discourage other, non-establishment types from following in Trump’s footsteps. It’s meant to convey the idea that if you challenge the establishment, the establishment will ruin you, your supporters, your associates, and your family. It is meant to prevent another such candidate from even attempting what Trump has done.
